Welcome to Crazy Cards AI ("we", "our", "us"). These Terms & Conditions ("Terms") govern your use of our iOS app and services. By accessing or using our app, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of our app.

Use of the App

1. Eligibility

  • You must be at least 13 years old to use our app. By using our app, you represent and warrant that you meet this age requirement.

  • We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes in accordance with these Terms.

3. Subscription Services

  • Plans: We offer a weekly subscription plan that provides unlimited gift card generations.
  • Payments: Payments are processed securely through our payment partners. By subscribing, you authorize us to charge your chosen payment method.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of the current billing cycle.
  • Refunds: All sales are final. We do not offer refunds except as required by law.

User Accounts

1. Account Responsibility

  • You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

2. Account Termination

  • We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Intellectual Property

1. Ownership

  • All content, features, and functionality, including but not limited to text, graphics, logos, images, and software, are owned by Crazy Cards AI or its licensors and are protected by intellectual property laws.

2. Restrictions

  • You may not copy, modify, distribute, sell, or lease any part of our app or services without our explicit written permission.

User-Generated Content

1. Responsibility

  • You retain ownership of any images or content you upload to the app. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing our services.

2. Proprietary Rights

  • The gift cards and images generated by our AI are owned by you. You have the right to use, modify, and distribute them as you see fit.

3. Prohibited Content

  • You agree not to upload any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, or otherwise objectionable.

Prohibited Uses

You agree not to use the app for any of the following purposes:

  • Engaging in any illegal activities.
  • Interfering with or disrupting the app's functionality.
  • Attempting to gain unauthorized access to our systems or networks.
  • Using the app to distribute spam, viruses, or other harmful software.

Limitation of Liability

To the fullest extent permitted by law, Crazy Cards AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the app.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any bugs, viruses, trojans, or the like that may be transmitted to or through our app by any third party.

In no event shall our total liability to you for all claims exceed the amount you have paid us, if any, in the last twelve months for the service giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Crazy Cards AI and its affiliates, licensors, and service providers from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

  • Your use and access to the app.
  • Your violation of any term of these Terms.
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

Disclaimers

  • As-Is Basis: The app and all information, materials, products, and services included are provided on an "as is" and "as available" basis, without warranty of any kind.
  • No Warranty: We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Governing Law
